Advocates in
California have forwarded this note to us in the national
office. While insurance laws differ from state to state, we
would like to share this note with you, our members. We know
that cancellation of homeowner's policies is a concern
nationwide. Laws that prohibit this kind of discrimination
are important in these kinds of situations. We encourage you
to become familiar with the insurance laws in your state and
to advocate for similar laws if your state does not have
any.
We (DCI)
recently intervened on behalf of a FCC Provider who received
notice of cancellation on her homeowner's policy because she
was doing child care in her home. We wrote the Insurance
company and copied a section of the CA Dept of Insurance
Code. This wording can be used for others who may experience
the same problem.

name) holds a FCC License. Under the laws of CA (Section
1597.40 of the Health and Safety Code), this is residential
use of the property, not business use. She has further
protection under Section 676.1 of the CA Insurance Code
which addresses the arbitrary cancellation or refusal to
renew homeowner's policies. It states that a company is
subject to sanctions should they do so.
We received
notice from the CA Dept of Ins. that the insurance company
has withdrawn its cancellation notice.
